1 Section 19 (10) of the Assessment Act, R.S.B.C. 1996, c. 20, is amended

(a) in paragraph (b) by striking out "section 967" and substituting "section 611", and

(b) in paragraph (c) by striking out "section 970.1 (3) (b)" and substituting "section 614 (3) (b)".

 
Auditor General for Local Government Act

2 Section 3 (6) (a) of the Auditor General for Local Government Act, S.B.C. 2012, c. 5, is amended by striking out "section 814 (3)" and substituting "section 377 (1)".

3 Section 13 (1) is amended in the definition of "treaty first nation" by striking out "Division 3.1 of Part 24" and substituting "Part 7".

 
British Columbia Transit Act

4 Section 8 (7) of the British Columbia Transit Act, R.S.B.C. 1996, c. 38, is amended by striking out "section 312" and substituting "section 292".

 
Building Act

5 Section 56 of the Building Act, S.B.C. 2015, c. 2, is repealed and the following substituted:

56 Section 297 (2) of the Local Government Act is repealed.

6 Section 57 is repealed and the following substituted:

57 Section 298 (1) (l), (n) and (o) is repealed and the following substituted:

  

(l) require the installation of smoke alarms in existing buildings and other structures and, in relation to this, establish standards and specifications for required smoke alarms and their installation;

(n) require the maintenance of "rental units" and "residential property", as defined in the Residential Tenancy Act, that are subject to a "tenancy agreement" as defined in that Act, in accordance with the standards specified in the bylaw;

(o) require the maintenance of "manufactured homes", "manufactured home sites" and "manufactured home parks", as defined in the Manufactured Home Park Tenancy Act, that are subject to a "tenancy agreement" as defined in that Act, in accordance with the standards specified in the bylaw.

 
Capital Region Water Supply and Sooke Hills Protection Act

7 Section 1 of the Capital Region Water Supply and Sooke Hills Protection Act, S.B.C. 1997, c. 5, is amended

(a) by adding the following definition:

  

"Municipal Act" means the Municipal Act, R.S.B.C. 1996, c. 323, as it read before August 30, 2000; , and

(b) in the definition of "participating area" by striking out "Part 24 of the Municipal Act;" and substituting "the Schedule to the Local Government Act;".

8 Section 2 is amended

(a) in subsection (5) by striking out "a service establishment bylaw under the Municipal Act." and substituting "an establishing bylaw under the Local Government Act." , and

(b) in subsection (7) by striking out "Part 24 of the Municipal Act" and substituting "the former Part 24 of the Local Government Act, as defined in the Schedule to that Act,".

9 Section 3 is amended

Cremation, Interment and Funeral Services Act

18 Section 37 (2) (a) and (3) (a) of the Cremation, Interment and Funeral Services Act, S.B.C. 2004, c. 35, is amended by striking out "section 195" and substituting "section 265".

 
Emergency Communications Corporations Act

19 Section 4 (3) of the Emergency Communications Corporations Act, S.B.C. 1997, c. 47, is amended by striking out "and 195" and substituting "and 265".

 
Environmental Management Act

20 Section 61 of the Environmental Management Act, S.B.C. 2003, c. 53, is amended

(a) by repealing subsection (1) (g) and substituting the following:

  

(g) a current or former "local public officer" as defined in section 738 (1) [immunity for individual local public officers] of the Local Government Act, and , and

(b) in subsection (2) (a) and (b) by striking out "section 946.1 or 946.2" and substituting "section 556 or 557".

21 Sections 158 and 159 are repealed.

 
Farm Practices Protection (Right to Farm) Act

22 Section 1 of the Farm Practices Protection (Right to Farm) Act, R.S.B.C. 1996, c. 131, is amended by repealing paragraph (b) of the definition of "land use regulation" and substituting the following:

  

(b) a bylaw under the following provisions of the Local Government Act:

section 318 [general animal control powers];

section 324 [noise control];

section 325 [nuisances and disturbances];

section 326 [fireworks restrictions]; .

23 Section 2 (3) (b) and (c) is repealed and the following substituted:

  

(b) despite section 416 [bylaw contraventions — offences and prosecutions] of the Local Government Act, a farmer does not contravene a bylaw made under the following provisions of the Local Government Act only by conducting that farm operation:

section 318 [general animal control powers];

section 324 [noise control];

section 325 [nuisances and disturbances];

section 326 [fireworks restrictions];

(c) despite section 274 [actions by municipality] of the Community Charter and section 420 [enforcement by civil proceedings] of the Local Government Act, a farmer must not be prevented by injunction or other order of a court from conducting that farm operation.

 
Fish and Seafood Act

24 Section 74 of the Fish and Seafood Act, S.B.C. 2015, c. 14, is amended by striking out "Section 872 of the Local Government Act, R.S.B.C. 1996, c. 323," and substituting "Section 455 of the Local Government Act".

 
Fish Protection Act

25 Section 12 (4) (b) of the Fish Protection Act, S.B.C. 1997, c. 21, is amended by striking out "Part 26" and substituting "Part 14".

 
Freedom of Information and Protection of Privacy Act

26 Schedule 1 to the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165, is amended in paragraph (g) of the definition of "local government body" by striking out "section 899" and substituting "Division 15 of Part 14".

 
Greater Vancouver Sewerage and Drainage District Act

27 Section 7 (1b) of the Greater Vancouver Sewerage and Drainage District Act, S.B.C. 1956, c. 59, is amended by striking out "Sections 186 and 187" and substituting "Sections 285 and 286".

28 Sections 7B (3) and 7C (3) are amended by striking out "Section 267" and substituting "Section 416".

29 Section 8 is amended

30 Section 14 is amended

31 Section 58.2 is amended

(a) in subsection (6) by striking out "section 933 (6)" and substituting "section 559 (5)", and

(b) by repealing subsection (9) and substituting the following:

   (9) Sections 511 [bylaws adopted after application for subdivision submitted] and 568 [bylaws adopted after application for rezoning, development permit or building permit submitted] of the Local Government Act apply to a by-law under subsection (1) of this section.

32 Section 59 is amended

(a) in subsection (2) by striking out "Section 846 (3) to (8)" and substituting "Section 765 (2) to (7)",

(b) in subsection (3) by striking out "Section 1021" and substituting "Section 764" , and

(c) in subsection (4) by striking out "section 1021 (4)" and substituting "section 764 (4)".

 
Greater Vancouver Water District Act

33 Section 5 (3) of the Greater Vancouver Water District Act, S.B.C. 1924, c. 22, is amended by striking out "Sections 186 and 187" and substituting "Sections 285 and 286".

34 Section 10 is amended

(a) in subsection (4) by striking out "section 783" and substituting "section 196",

   (1) So far as the terms defined can be applied, the definitions established by or applicable under the following apply to all enactments relating to municipal and regional district matters:

(a) the Schedule to the Community Charter;

(b) section 1 of the Schedule to the Local Government Act.

   (1) The following provisions apply to the trust council:

(c) section 225 (1) (a) and (b) [procedure bylaws] of the Local Government Act.

45 Section 26 (1) to (1.2) is repealed and the following substituted:

   (1) The following provisions of the Local Government Act apply to the local trust committees:

(a) section 225 (1) (a) and (b) [procedure bylaws];

(b) Division 1 [Challenge of Municipal Bylaws and Other Municipal Instruments] of Part 16, other than

(i)   section 624 (1) [limitation period on application for declaratory order], and

(ii)   section 626 [assessment or rate stands unless instrument set aside].

(1.1) For the purposes of section 623 (4) [notice of application to set aside bylaw or other instrument] of the Local Government Act as it applies to a local trust committee, the notice under that section must be served on the secretary.

(1.2) The following provisions of the Community Charter apply to the local trust committees:

(a) section 122 [exercise of powers by bylaw or resolution];

(b) section 135 [requirements for passing bylaws];

(c) section 136 [when a bylaw comes into force];

(d) section 139 [consolidation of bylaws];

(e) section 140 [revision of bylaws];

(f) section 163 [evidence of municipal bylaws and other records].

46 Section 28 (1) is repealed and the following substituted:

   (1) For the purposes of enforcing its bylaws and section 32 of this Act, a local trust committee has all the power and authority of a regional district board.

(1.1) Division 1 [Bylaw Enforcement and Related Matters] of Part 12 [Regional Districts: Bylaw Enforcement and Challenge of Bylaws] of the Local Government Act, other than section 413 (2) and sections 421 to 424, applies to a local trust committee in relation to subsection (1).

47 Section 29 is amended

(a) by repealing subsection (1) and substituting the following:

   (1) Each local trust committee has, in respect of its local trust area, all the power and authority of a regional district board under the following enactments:

(a) the following provisions of Part 9 [Regional Districts: Specific Service Powers] of the Local Government Act:

(i)   section 298 (1) (j) [regulation of construction and layout of trailer courts, manufactured home parks and camping grounds];

(ii)   section 327 [removal and deposit of sand, gravel and other soil];

(b) Part 14 [Planning and Land Use Management] of the Local Government Act, other than the following:

(i)   sections 507 [requirements for excess or extended services] and 508 [latecomer charges and cost recovery for excess or extended services];

(ii)   Division 19 [Development Costs Recovery];

(iii)   Division 20 [School Site Acquisition Charges], except for section 574 [determination of eligible school site requirements];

(c) section 242 [approval for conversion of previously occupied buildings] of the Strata Property Act;

(d) the Real Estate Development Marketing Act;

(e) the Agricultural Land Commission Act. , and

(b) by repealing subsection (3.1) and substituting the following:

   (3.1) Despite subsection (2), if an official community plan includes a provision under section 485 (1) [development approval information areas or circumstances] of the Local Government Act, the trust council rather than the local trust committee must adopt the required bylaw under section 486 [bylaw authority in relation to development approval information] of that Act.

48 Section 36 (2) (a) is amended by striking out "section 29 (1) (a)" and substituting "section 29 (1) (b)".

49 Section 39 is repealed and the following substituted:

Withholding of building permits in relation to bylaws in preparation

39  (1) A regional district board may direct that a building permit be withheld if a local trust committee advises the board that the local trust committee proposes to adopt

(a) an official community plan, or an amendment of it, or

(b) a zoning bylaw, or an amendment of it.

(2) If a direction under subsection (1) is made, section 463 [withholding of building permits that conflict with bylaws in preparation] of the Local Government Act applies to the local trust committee.

50 Section 55 (3) is repealed and the following substituted:

   (3) A bylaw under section 734 (1) or 930.1 of the Municipal Act, R.S.B.C. 1979, c. 290, or under section 930 (1) (d) or (e) of that Act as it read before section 930.1 of that Act came into force, that was adopted by a municipality or regional district before April 1, 1990, being the date on which this Act came into force,

(a) remains in force to the extent that the bylaw applies to a local trust area, and

(b) may be repealed, amended or enacted again by the local trust committee

as if the bylaw had been adopted by the local trust committee.

   (1) A local government must not do any of the following in respect of land that is private managed forest land if doing so would have the effect of restricting, directly or indirectly, a forest management activity:

(a) adopt a bylaw under any enactment;

(b) issue a permit under section 8 (3) (l) [authority in relation to buildings and other structures] of the Community Charter or Division 1 [Building Regulation] of Part 9 [Regional Districts: Specific Service Powers] of the Local Government Act;

(c) issue a permit under Part 14 [Planning and Land Use Management] of the Local Government Act.
