MOTORCYCLE NOISE CONTROL ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definitions

1 In this Act:

"motorcycle" has the same meaning as defined in the Motor Vehicle Act;

"excessive noise" means a noise of a level greater than the maximum allowable Sound Pressure Level of 85 DBA when operated in an area where the posted or un-posted speed limit is 60 km per hour or less.

Muffler

2 Notwithstanding any regulations enacted pursuant to the Motor Vehicle Act:

(1) A motorcycle, propelled by an internal combustion engine shall be equipped with an exhaust muffler consisting of a series of pipes or chambers which ensures that the exhaust gases from the engine are cooled and expelled without excessive noise.

(2) A person that causes or permits to be operated a motorcycle so as to create excessive noise when operated in an area where the posted or un-posted speed limit is 60 km per hour or less commits an offence.

Commencement

3 This Act comes into force by regulation of the Lieutenant Governor in Council.
