Explanatory Notes

SECTION 1: [Tobacco Tax Act, section 5.1] prohibits the sale or offer for sale of tobacco from licensed pharmacies in British Columbia.

SECTION 2: [Tobacco Tax Act, section 39] adds contravening section 5.1 as an offence.

SECTION 3: [Tobacco Sales Act, section 2] prohibits a licensed pharmacy from dealing in, selling, offering for sale, distributing, advertising or promoting the use of tobacco.

TOBACCO STATUTES (PROHIBITING TOBACCO SALES FROM PHARMACIES) AMENDMENT ACT, 2006

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

 
Tobacco Tax Act

1 The Tobacco Tax Act, R.S.B.C. 1996, c. 452, is amended by adding the following section:

Prohibition against selling tobacco from pharmacy

5.1 (1) Tobacco must not be sold or offered for sale from a licensed pharmacy in British Columbia.

(2) A dealer's permit or retail authorization may not be held by and must not be issued to a licensed pharmacy in British Columbia.

(3) For the purposes of this section, a licensed pharmacy includes a retail outlet in which a licensed pharmacy is located.

2 Section 39 (4) (a) is amended by striking out "5" and substituting "5 or 5.1".

 
Tobacco Sales Act

3 Section 2 of the Tobacco Sales Act, R.S.B.C. 1996, c.451, is amended by adding the following subsections:

(4) A licensed pharmacy must not deal in, sell, offer for sale, distribute, advertise or promote the use of tobacco.

(5) For the purposes of subsection (4), a licensed pharmacy includes a retail outlet in which a licensed pharmacy is located.
